About these terms

These terms and conditions, together with the documents which they refer to, set out the terms for use of the website www.charterpath.org.uk (the “Site”), whether you use the Site as an individual looking to volunteer (“Volunteer”) or as a non-profit organisation (“Non-profit”) or in any other capacity (in each case a “User”).

These terms and conditions (the “Terms”) are terms of a contract whereby we provide you with access to our Services (defined below). Nothing in these Terms will create any relationship of partnership, agency or employment between us.

By using the Site you are agreeing to these Terms. From time to time Charterpath may change these Terms.  You will be deemed to have agreed to any amended Terms when you next use the Site following any amendments. If you do not agree with these Terms, please do not use the Site.

These Terms shall be governed by the laws of England and Wales and any disputes arising shall be exclusively subject to the jurisdiction of the courts of England and Wales.

Who we are

The website www.charterpath.org.uk is owned and operated by Charterpath CIC (“Charterpath”). Charterpath is a company registered in England and Wales, company number 13274212 with a registered address at 29 Elthiron Road, London, SW6 4BP. You can contact us by email at info@charterpath.org.uk.

Charterpath was established with an aim to inspire individuals with accounting and financial skills to volunteer their time and expertise to the non-profit sector and to support them in their roles as volunteers. 

We provide a platform to deliver the following (the “Services”):

  • Non-profit organisations can post opportunities for volunteers with financial skills

  • Individuals looking for voluntary work can search these opportunities and apply to the non-profit opportunity directly through the Site

  • Charterpath provides assistance, information, support and guidance about volunteering and related issues to site users; and

  • Individuals can register to join the Charterpath database and mailing list

Responsibilities for all users of this site

You will use the Site for honest purposes and not to encourage any unlawful purpose. Charterpath  may at its discretion deny you access to the Site without warning or explanation if you breach these terms or if we believe it is necessary to protect our interests or those of other Users.

You will not post or transmit on the Site any libellous, abusive, threatening, harmful, vulgar, obscene or otherwise objectionable material. It is possible that you will communicate outside of our Services with other Users. Whenever you communicate with other Users in the context of the Services, you must not abuse or threaten them, use discriminatory language, mislead them or make them promises you do not intend to keep. Charterpath shall have the right to delete from the Site immediately and without prior notice any material that it deems not to comply or to be objectionable for any reason.

You will not post or transmit on the Site any material which contains any virus or disabling devices which may interfere with the operation of the Site; or which alters or deletes any information which you have no authority to alter or delete; or which overloads the Site by spamming or flooding it. You will not use any device, routine or software to crash, delay or otherwise damage the operation of this Site. 

Where another User shares with you in the context of the Services, information which they describe as confidential, or which is obviously confidential, you must not share that information with anyone else without their permission, unless you are required to do so by law. You must not post any confidential information (whether yours or another User’s) which is visible to Users generally, and we will not have any liability if you do.

As the Services of the Site are made available to all Users, you do not enjoy any cancellation of “cooling-off” rights in relation to these Terms and Conditions.

Your additional responsibilities as a Volunteer

You will not post or transmit on the Site inaccurate, incomplete or false information. If we ask you to provide us with certain information about you, such as your full name, contact details and any biographical information, that information must be true, complete and current. You may not register to join us using an assumed name or someone else’s identity.

Our Services allow you to apply for volunteer roles directly, submitting a copy of your CV. You should not apply for a job unless, based on the information which the Non-profit has provided, you are reasonably satisfied that you have the skills, knowledge, resources and experience necessary for the opportunity.

Your additional responsibilities as a Non-profit

Our role is to provide the platform facilitating these connections, not to oversee them, and we are not party to any subsequent engagement between Volunteers and Non-profits. We do not operate a vetting procedure nor do we run background checks and therefore we cannot take responsibility for the accuracy or completeness of information that any Users provide.

Our Services are only open to Non-profits who are directly looking to recruit a Volunteer. You may not use this site or promote an opportunity on behalf of another Non-profit nor duplicate roles by copying other adverts of third parties or advertised by other agencies. You may not use the Site to promote any third party recruitment website or service. Similarly you may not seek commission in recruiting a volunteer.

Our Services allow you to upload various materials, including text, images and video, which other Users will see. You must ensure that you have all the necessary rights to use that material and to share it with us and with other Users of our Services, and you must ensure that such material does not contain anything which is unlawful, offensive, obscene or defamatory.

You retain all of your ownership rights in your content, but you are required to grant us and Users of the Services a limited licence to use, store and copy that content and to distribute and make it available to third parties. The rights you licence to us are described in the section ‘Intellectual Property Rights’.

All opportunities posted must comply with laws protecting equal opportunities and preventing discrimination. We reserve the right to remove from our Services any opportunity which you post in breach of these terms.

No reliance on information

The content available on our Site is provided for your general information only. It is not intended to amount to advice on which you should rely.

Although we make reasonable efforts to update the information available on our Site, we make no representations, warranties or guarantees, whether express or implied, that its content is accurate, complete or up-to-date.

As a convenience to you, this Site contains links to external websites. Charterpath accepts no responsibility for or liability in respect of the content of those sites.  The use of any such links is entirely at your own risk.

Your privacy

By using our Site you agree to the processing of your personal data set out in our Privacy Policy so please read it carefully.

We have the right to disclose your identity to any third party who is claiming that any content posted or uploaded by you to our Site constitutes a violation of their intellectual property rights, or their right to privacy.

Charterpath may gather information and statistics collectively about all visitors to this Site which may include information supplied by you. This will help us to understand its users thereby creating better products and services for you. Charterpath will not disclose individual names or identifying information. All data will be in aggregate form only. Charterpath may share this anonymous aggregated data with selected third parties to assist with these purposes. 

Intellectual Property Rights

We own or are licensed to use the intellectual property rights in our Services, including our branding, trademarks, logo and software.

You may not download, copy or print any of the pages of the Site except for your own personal use, and provided you keep intact all copyright and proprietary notices. No copying or distribution for any business or commercial use is allowed.

You will not attempt to decipher, disassemble, reverse engineer or modify any of the software, coding or information comprised in the Site; nor will you post to the Site any material which infringes any intellectual property rights of any third party.

When you upload or post content to our Site, you grant the following licences:

  1. a perpetual, worldwide, non-exclusive, royalty-free, transferable licence to us to use, reproduce, distribute or display your content in connection with the Services across all media including but not limited to a promotion of the Services; and

  2. a worldwide, non-exclusive, royalty-free licence to all Users to use the content for their purposes in connection with Services that will terminate upon deletion of your content.

Availability of this Site

The views expressed by other Users on our Site do not represent our views or values.

If a dispute arises between Users, we may offer our assistance to resolve the matter but we are under no obligation to achieve a compromise or resolution, and Users remain responsible for resolving disputes according to the contract between them.

No liability is accepted by Charterpath for any loss or damage which may arise out of any User relying on or using any information on this Site. Charterpath shall not be liable to any User relying on or using any such information for (a) loss or revenue, loss of actual or profits whether arising in the normal course of business or otherwise (including without limitation, loss of profits on contracts); loss or damage to volunteering prospects, loss of opportunity; loss of the use of money; loss of anticipated savings; loss of business; loss of goodwill; loss of or damage to reputation; loss of or corruption to data; loss of management or administration time, legal and other professional fees and expenses; or (b) any indirect or consequential loss or damages however caused (including without limitation by reason of misrepresentation, negligence, other tort, breach of contract or breach of statutory duty) which arise directly or indirectly from the subject matter of this Site.  However, nothing in the above shall limit or exclude Charterpath’s liability for fraud or for death or personal injury caused by negligence, or to the extent otherwise permitted by law.

You agree fully to indemnify Charterpath against all costs, expenses, claims, losses, liabilities or proceedings arising from misuse by you of the Site, or from any breach by you of these terms relating to your use of the Site.

We will not be liable for any loss or damage caused by a virus, distributed denial-of-service attack, or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our Services or to you downloading of any content on it, or any website linked to it.

We assume no responsibility for the content of websites linked on our Site. We will not be liable for any loss or damage that may arise from your use of them.

Charterpath does not guarantee that any organisation will register any appropriate volunteering opportunities, or that any organisation will interview or recruit any volunteer to carry out such volunteering opportunity, or that any suitable volunteer will be available or will meet the needs of any organisation registering volunteering opportunities with it. Charterpath makes no representation or warranty as to the final terms and duration of any volunteering appointment facilitated and / or obtained through this Site.

Whilst Charterpath takes all reasonable endeavours to ensure it is the case, Charterpath does not guarantee that any organisation will keep confidential any volunteer information or data provided by Charterpath to them.

If any provision of these terms is held to be invalid by a court of competent jurisdiction, such invalidity shall not affect the validity of the remaining provisions of these terms and shall remain in full force and effect.
